Guide to Fireworks in the Commonwealth of Virginia

Fireworks laws vary across Virginia. Check local ordinances before use. Only approved items on the 2025 list may be legally sold and used.
Fireworks are regulated at both the state and local levels. Many jurisdictions in Virginia prohibit the use of all fireworks. Individuals are strongly encouraged to consult their local government to determine applicable ordinances prior to purchase or use.
Pursuant to Virginia Code §27-96.1, unless otherwise restricted by local ordinance, the provisions of the Statewide Fire Prevention Code do not apply to the use of permissible fireworks* on private property with the consent of the property owner.
These items must appear on the 2025 Virginia Permissible Fireworks List, having been tested and verified by the State Fire Marshal’s Office in accordance with the standards of the American Fireworks Standards Laboratory (AFSL).
Only those items that meet these standards are classified as “permissible fireworks” and may be legally sold and used in the Commonwealth. This process is critical to reducing the risk of injury and property damage.
*Local jurisdictions may adopt more stringent regulations under Virginia Code §27.97. Individuals must comply with all applicable local laws.
Firework Safety Guidelines
Prior to Use
- Purchase only legal fireworks from approved vendors.
- Do not attempt to manufacture or modify fireworks.
- Keep a bucket of water or fire extinguisher nearby.
- Review and comply with all local ordinances.
- Wear protective eyewear.
- Follow all manufacturer instructions.
- Never aim fireworks at people, animals, vehicles, or structures.
- Avoid use near dry vegetation or flammable materials.
- Do not use fireworks while under the influence of alcohol or controlled substances.
- Soak used fireworks in water before disposal.
- Wait at least 15 minutes before handling any malfunctioning devices (“duds”), then submerge them in water.
- Store unused fireworks, matches, and lighters out of reach of children.
- Monitor the area for potential smoldering or re-ignition.
